Purpose of this Page

Our organization as any other has rules that gide it in it's operation and management.   As a member of the Veterans of Foreign Wars of the United States and Dudley Ives, VFW Post 6386, it is important that you, as members, are familiar with the By-Law's .   We are currently revising these By-Laws to better manage our Post Home and conform to the By-Laws of National, District, and the Department of Texas.   This page will will provide you with the proposed revisions.   Your comments and recomendations will be welcome.  It's your Post and you DO Have a VOICE,

ARTICLE I - NAME and LOCATION

 

Section 1. Name: By virtue of the Charter granted, this organization shall be known as DUDLEY IVES POST 6386, Veterans of Foreign Wars of the United States.

 

Section 2. Location: The Location of this Post shall be 1452 Hwy 361, in the city of Ingleside, Texas. The Post mailing address shall be, VFW Post 6386, P.O.Box 1207, Ingleside, Texas 78362

 

ARTICLE II - SUBORDINATION

 

Section 1. The Supreme Power of this association is vested in the National Convention and this Post shall be at all times governed by the Congressional Charter and By - Laws of the Veterans of Foreign Wars of the United States, the By - Laws of the Department of Texas, and orders issued by authority of the National Convention, National Council of Administration, the Commander-in-Chief: Department Commander of the Department of Texas, and the Department Council of Administration. For the purpose of this Article and Section, Resolutions by the National Convention are held to be lawful orders.

 

ARTICLE III - MEETINGS

 

Section 1. Place: The regular meeting place of this Post shall be Post 6386 Hwy 361, in Ingleside, Texas. The Post may change its meeting place in accordance with the provision of the National By - Laws, Article II Post, Sec 206 ( A Post may, after at least fourteen (14) days written notice to the Department Commander and members of the Post, change its meeting place, appointed day or time upon a majority vote of the membership present at a regular or special meeting).

 

 

 

 

Section 2. Time: The stated meeting time of the Post shall be at 1900 on the First Tuesday of every month. The meeting day and time can only be changed by a two thirds (2/3) vote of the membership present at any regular meeting.

 

Sec. 3. Special Meetings: Special meetings must be called for a date not more than fourteen (14) days after: (a) The Post Commander receives the signed, written request; or (b) The majority vote of the members present at a regular meeting; ( ) The date upon which the Post Commander determines that a Special meeting maybe necessary.

The Post Adjutant shall give notice, in writing, of the time and place of the Special meeting and of the business to be transacted, such notice shall be given in such a manner as to reasonably reach members at least forty eight (48) hours in advance of the time set for the meeting. No business shall be transacted at any Special meeting except that for which it is called.

Sec. 4. Quorum: Six (6) members in good standing, (dues paid-up) shall constitute a quorum for the transaction of business.

 

Sec. 5. Post Quartermaster/Adjutant will record and maintain copies of all Post, Committee , and House Meetings in the Office of the Post. Minutes of all meetings will be made available for quick reference during meetings and/or in the absence of the Post Quartermaster/Adjutant.

 

ARTICLE IV - MEMBERSHIP

 

Sec. 1. Membership in this Post, eligibility, application for, and maintenance of, shall be in accordance with Article I of the National By - Laws Disciplinary action shall be in accordance with Article IX of the National By - Laws.

 

Sec. 2. The admission to this Post Shall be open to the public, in accordance with the National By-Laws.

 

Sec. 3. The dues of this Post shall never be less than the amount required to cover Department and National Dues. The Post membership in good standing, at any general Post meeting, may approve a raise in dues.

 

 

 

 

 

 

ARTICLE V - OFFICERS

Sec. 1. Eligibility to hold an elected or appointed Office of this Post shall be in accordance with Article I, Sec 101, of the Manual of Procedures.

Sec. 2. Elections, will be held in April on the first meeting date. Prior to the opening of elections, the Post shall decide which form of elections shall be used, balloting by open vote or written secret ballot.

Sec. 3. The duties of the Elected or Appointed Officers, or Chairperson shall be in accordance with Sec, 218 of the Manual of Procedures.

Sec. 3a. Any Post Officer responsible for Post monies shall be bonded in accordance with Article VII, Sec. 703. (Bonds) of the National By-Laws.

 

Sec. 4. In the event an elected/appointed officer/chairperson of this Post cannot serve his term or is dismissed for cause, or valid excuse, absents themselves from two (2) consecutive meetings of the Post and/or Committee (s) shall be declared vacant. Procedures to fill the vacancies shall be undertaken in accordance with Sec. 220 of the National By - Laws.

ARTICLE VI - COMMITTEES

 

Sec. 1. All Committees, unless otherwise directed by the Manual of Procedures and National By - Laws, shall, as promptly as possible after elections, be appointed by the Post Commander and approved by the Post Membership. The Post Quartermaster, by virtue of his Office, shall de Treasurer of all Committees handling funds. Committee Chairperson and/or Managers that handle funds will maintain record copies of meetings and fund transactions and make an oral and submit a written report during regular Post meetings.

 

Sec. 2. The Standing Committees of this Post shall be:

(A) Membership © Building and Grounds

(B) House (D) RV Park

(E) BINGO

 

 

Sec. 2a. Special Committees, when required or desired, may be authorized by the Post membership or Post Commander. The duties/responsibilities of these Committees shall be governed by the Post Membership and Sec 1. Of these By-Laws.

 

Sec. 3. House Committee: The affairs and management of the Post Property, included but not limited to the Post Canteen, shall be vested in the Post House Committee.

 

Sec. 3a. Membership: The House Committee shall consist of six (6) members in good standing, all who will be voted to the Committee by the Post Membership. By virtue of his/her office, the Post Commander shall serve as Chairperson, and Post Quartermaster as the Committee Treasure but not have a vote. No member of the House Committee shall be employed in any capacity by the Post.

 

 

 

 

Sec. 3b. Vacancies: Article V, Sec 4 of these By-Laws will govern vacancies of this Committee.

 

 

 

 

Sec. 3c. Meetings: The House Committee shall meet once monthly. One (1) hour prior to the first monthly Post meeting. Minutes of the meeting, to include all transactions, shall be made a permanent record. All Committee Chairpersons are to attend. This is considered an open meeting to all members and guest of this Post.

 

Sec. 3d. Quorum: Four (4) elected members of the House Committee have to be present to constitute a quorum for the conduct of business.

 

Sec. 3e. Removal for Cause: Any member of the House Committee may be removed by majority vote and approved by the Membership. In addition, any member of the House Committee may be subject to disciplinary action under the provisions of Article IX of the National By - Laws.

 

 

Sec. 3f. Employment: It is the responsibility of the House Committee to

hire a Canteen Manager either from the Membership or out-side the Post. The Post Membership must approve the appointment at the next regular Post Meeting. Addendum A provides for the prerequisites for employment and duties as the Canteen Manager.

Sec. 3g. Post Hall Rental: The House Committee shall establish a Rental Contract and prices for the Post Hall and/or Properties. The Post has priority over all agreements.

 

Sec. 3h. Expenditures: The House Committee shall be responsible for providing, recommendations, reports, and proposals to the General Membership on all matters pertinent to the expenditure of funds, repairs, replacement, requisition, construction, or alterations to the Post Canteen and properties. The House Committee shall authorize the Canteen Manager the authority to approve emergency repairs to the Post Home not to exceed $500.00 Dollars. Any additional repairs or expenditures must be approved by the House Committee.

 

 

 

 

Sec. 3i. Special Meetings: Special meetings of the House Committee may be called by the Post Commander, Canteen Manager, or any member of the Post in good standing alleging misconduct against another member. The Post Commander will determine whether a special meeting need to be called or if the matter can be tabled until the next regular meeting. Special meetings of a disciplinary nature are closed sessions.

 

ARTICLE VII - CANTEEN MANAGEMENT

 

 

Sec. 1. Management: The House Committee shall hire/appoint a Canteen Manager whose duties shall be to manage the affairs of the Canteen and be responsible to the House Committee for the proper operation of the Post Canteen. Priority of employment shall be given to Post Members in good standing.

 

Sec. 2. Suspension: The House Committee may suspend all Canteen privileges for violations of Canteen rules or any act of misconduct upon Post premises, for whatever period of time the Membership determines proper, subject to an appeal to the full membership.

 

Sec. 3. Appeal: The Post Membership may sustain, overrule, any action of the House Committee by a majority vote at any Post Meeting I accordance with the provisions in Article IX of the National By-Laws.

 

 

 

 

Sec. 4. Bonding: The Canteen Manager and any employee handling Canteen monies will be bonded by a Surety Company in the sum of not less than $1000.00.

Article VII, Sec 702---Politics

   No officer or member of the Veterans of Foreign Wars of the United States shall in any manner use the Veterans of Foreign Wars for partisan politics and no discussion of partisan questions shall be permitted at any meeting nor shall any nominations, recommendations or endorsements for political office be made, provided this shall not apply to discussion of policies of any organization that seeks to alter our present form of government by force, violence or other unlawful means.

   Participation in activities supporting or opposing legislation or administration of laws for the veteran’s welfare or relating to other matters pertaining to the purpose of the organization shall be permitted.   Such participation shall be consistent with the legislative and welfare programs and policies approved by the National Convention.

   No Post, County Council, District, or Department shall participate in a labor dispute, either on behalf of labor or management.   No member of the Veterans of Foreign Wars of the United States shall wear the VFW uniform or VFW Cap in any plant or picket line or meeting of employees where labor dispute arises.

   Nothing contained in this section shall prevent the organization of a lawful political action committee to further the purposes of the VFW as set forth in section 3 of the Congressional Charter, nor prevent any discussion of the activities of such a committee.
